There have been some real bargains recently. There was an Aria Pro 2 SB700 with a case in great nick for £120 local to me, but despite me contacting the gumtree seller instantly I saw it, it was already gone.

Thanks for the tip-off, Thunder-Chunder.  I emailed - unbelievably it was still available - arranged to get there later this morning to pick up, got the address and his mobile number - even told my son what he was getting for Christmas.  Then about 11 last night he emails to say that a "family friend" has offered him more so the guitar is no longer available.  He didn't even ask me first.  Kept me awake half the night thinking about it.  Isn't there a law against this sort of thing?

I saw the listing had been taken down last night so hoped it had gone to someone in here but that sucks, would appear the seller hasn't heard the term a gentleman's agreement

I'm not a lawyer, but I would guess that a contract hadn't been formed at the time the seller backed out.

There was an early Korean looking Aria Pro II on gumtree for £40. I thought it worth a shot. But I didn't receive a reply to my email for a few days. When a reply came back, it said that due to the number of responses, clearly they had misjudged the price, and it was now £90. I didn't feel like continuing on in the slightest.

I think I realised I was "stealing" it in the first place but it really was up to him to check out a reasonable price - which wouldn't have been difficult since there's an identical guitar on ebay at the moment.  What's annoying is that he didn't ask me politely if I would like to match the other offer.  He didn't even seem to think there was anything wrong with ditching me like that.  It must be the new way of things...  I think I'm getting old...

I seem to recall covering situations like this at college many moons ago, and I do think that a verbal (oral) contract is as legally binding as a written contract...it is just harder to prove because it is your word against his.
If you had an agreement, through Gumtree, via email, and you really wanted the guitar I'm pretty sure you could take appropriate action and would be successful.

But I'm not 100% on this - it's just a gut feeling....

You'd have to show that the seller intended to create a legal contract through the email agreement. The offer and acceptance may be there, and the consideration may be there, but showing that the seller intended to create a contract may be tricky. It may come down to the actual language used in the seller's email. Though, I'm not a lawyer so I don't claim that anyone should take much notice of this.

You could summarily execute him. Or torture his cat or put dog poop in a paper bag on his door step, set it alight, ring the door bell and run away.

It's the internet. I don't think anyone expects you to take him to court. But that doesn't stop people discussing the what-ifs and how-ifs.

I can point you to entire forums where people are discussing how they would survive in a coming zombie apocalpyse.

If it really was zombie apocalypse, I would kill people and eat them. I'd be fine.
